A magistrate serving on the West Midlands and Warwickshire circuit has been formally reprimanded for a series of misconduct incidents during court proceedings, including swearing and showing visible frustration.

Dr Amy Delicate, who had maintained a five-year unblemished record, received formal advice from High Court judge Mr Justice Keehan following an investigation by the Judicial Conduct Investigations Office (JCIO).

Details of the misconduct

The investigation found that Dr Delicate's behaviour in a family court hearing included audible sighing, banging her desk, and using inappropriate language.

Furthermore, she was reported to have made "prolonged eye contact" with an individual involved in the case and was "visibly frustrated throughout" the proceedings.

Multiple witnesses interpreted her conduct as demonstrating frustration and partiality, potentially undermining the perceived fairness of the hearing.

Outcome and response

While the JCIO noted that the hearing itself was not disrupted and its outcome remained unaffected, they concluded that her behaviour caused embarrassment to court staff and negatively impacted the working environment.

In her defence, Dr Delicate stated that any swearing or displays of frustration were "unintentional." She also offered a qualified apology, stating she was sorry "if such behaviour occurred" and suggested some actions may have been misinterpreted.

However, the JCIO stated that she did not demonstrate full insight into the implications of her conduct, despite her previously clean record.

The formal advice was issued by Mr Justice Keehan on behalf of the Lady Chief Justice and with the agreement of the Lord Chancellor, concluding this disciplinary matter.
