A drink-driver who crashed his car on the M42 while more than double the legal alcohol limit has been banned from driving for 40 months at Birmingham Magistrates' Court. Alexis Rhodes, 44, of Cambridge, admitted it was a 'stupid mistake' after his BMW struck a barrier in the fast lane between junctions 5 and 5A on April 26.
Twice Over the Limit
Police tests revealed Rhodes had 75 micrograms of alcohol in his breath — more than twice the legal limit of 35 micrograms. The court heard that this was his second drink-driving offence, having been convicted previously in 2021. He pleaded guilty to driving above the alcohol limit.
Defence Statement
Rhodes told his solicitor he had 'let himself and his father down' by his actions. His defence lawyer stated: 'He said: "I accept what I have done, I am sorry. It was a stupid mistake to make and I will suffer the consequences."'
Caring Responsibilities
The court was informed that Rhodes is a father-of-two, with children aged 13 and 16, and also cares for his elderly father while receiving Universal Credit. His defence requested leniency in light of these caring duties.
Sentencing
Magistrates imposed a 40-month driving ban and fined Rhodes £120. He was also ordered to pay a £48 victim surcharge and £85 in prosecution costs, bringing the total financial penalty to £253.
