A planning committee chairman expressed dissatisfaction but ultimately approved a controversial garage in Cheswick Green, citing no valid planning reasons to refuse the application.
Application Details
Matthew Lee applied for a garage at his home on Badger Close in February. The plan was escalated to Solihull Council's planning committee after six objections from neighbours. The garage would be located in the garden, with access from Glenwood Drive.
Neighbour Concerns
Planning officers recommended approval, stating it would not harm neighbour amenity. However, concerns were raised about an alleyway running alongside the property, which would pass in front of the garage. A statement from Glenwood Drive resident Janet Poulton highlighted that Glenwood Drive is not the applicant's road, but would be used for convenient access. She noted the narrow footpath is used by children, dog walkers, and pedestrians, and that visitor parking is limited. Cheswick Green Parish Council also expressed concerns, stating the path is frequently used by children, heightening accident risks.
Committee Debate
Committee Chairman Councillor Bob Grinsell noted the entrance from the road appeared steep. Planning officer Rebecca Hadley confirmed a ramp into the garage. Grinsell admitted he was not happy but struggled to find a planning reason to refuse. Councillor Yvonne Clements called it overdevelopment, cutting the garden in half. Officer Kim Allen countered that the owner is entitled to build on half the garden under permitted development rights, and future buyers must beware. Clements remained uneasy.
Mitigation Measures
The chairman suggested a drop kerb and warning signs, as the public right of way could involve cars reversing. Councillor Jane Lamden questioned what would prevent residents from parking in front of the garage if no drop kerb was required. Allen explained highways could enforce the drop kerb; without it, the public could park there. The committee voted six in favour, two against, approving the garage subject to conditions including an informative for the applicant to install the drop kerb.
