Birmingham drug driver four times over limit banned

A drug driver who was more than four times over the legal limit has been banned from driving for 16 months after telling a court 'it won't happen again'. Tyler Nixon, 22, of Umberslade Road, Birmingham, was already serving a suspended sentence for another crime when he was sentenced for drug-driving at Birmingham Magistrates' Court this week.

Police chase and arrest

Police followed Nixon's Seat Arona from Frankley Beeches Road on December 15 last year before stopping him in a car park. A roadside drug test was positive for cannabis, and a subsequent blood sample showed he had 9g/L of delta-9 tetrahydrocannabinol in his system, more than four times the legal limit of 2g/L.

Court appearance

Nixon, who represented himself in court, pleaded guilty to driving with a proportion of a specified controlled drug above the limit. When asked if he had anything to say, he replied: 'It won't happen again.' He expressed remorse, saying 'Yeah, of course' when asked if he was sorry.

Previous convictions

The court heard Nixon has four convictions for five offences, including a burglary and theft conviction in 2026. Prosecuting, Charmaine Robinson said: 'Police constables were behind the car and followed it into a car park. Once in the car park they stopped the car. The driver was identified as the registered keeper. Evidence was consistent with cannabis use in the vehicle.'

Sentence

The magistrates handed Nixon a 12-month community order with 50 hours of unpaid work and 10 rehabilitation activity requirement days focusing on critical thinking. The chair of the magistrates said: 'In your case, you were 4.5 times over the limit. We find this falls within category C but at the upper end. You will need to engage with probation. We are aware that you are already on a suspended sentence order, this will run parallel to that.'

Nixon was also ordered to pay £199 in costs and banned from driving for 16 months. The chair warned: 'If you drive while disqualified you will commit an offence and may be sent to custody and be disqualified again.'
