Martin Lewis Issues Urgent Warning Over State Pension Error
Financial guru Martin Lewis has issued a critical alert regarding a significant state pension error that could see thousands of people, particularly women aged 40 to 90, owed substantial back payments. The Money Saving Expert highlighted this issue on his BBC podcast, describing it as an "important heads up" that primarily affects those who took time off work between 1978 and 2010 to care for children or long-term disabled individuals.
Who Is Affected and Why?
This error revolves around Home Responsibilities Protection (HRP), a scheme designed to safeguard the State Pension entitlements of parents and carers by providing National Insurance credits for years they were not working due to caregiving responsibilities. HRP was replaced by National Insurance credits on April 6, 2010. However, it is estimated that over 100,000 individuals, especially women in their 60s and 70s, did not receive these credits as intended.
Martin Lewis explained, "You were meant to have got Home Responsibilities Protection, which should have given you National Insurance years to replace the ones you weren't getting by working. You need those National Insurance years to get a full state pension." He emphasized that while the government previously attempted to contact affected individuals, this effort has ceased, placing the onus on people to check their eligibility.
Potential Payouts and Government Action
The financial implications are substantial. For example, one individual named Cilla received £31,674 in back pay for 15 years of underpayment. Overall, the Department for Work and Pensions (DWP) estimates it has underpaid pensioners by between £300 million and £1.5 billion due to HRP recording mistakes.
HM Revenue and Customs (HMRC) is actively working to identify those who may have been entitled to HRP between 1978 and 2010 but do not have it registered on their National Insurance records. HMRC is sending letters to some individuals, but many may need to take proactive steps.
Steps to Check Eligibility
Martin Lewis advises affected individuals to:
- Visit gov.uk to check if they are projected to receive the full state pension.
- Identify any gaps in National Insurance years between 1978 and 2010.
- Determine if those gaps were due to caring for children under 16 or someone with long-term disabilities.
- Research Home Responsibilities Protection and make a claim if eligible.
HMRC stated, "We will send you a letter if we think you may have missing Home Responsibilities Protection. We want to help you make sure you receive the right amount of State Pension, so we're asking you to check if you were eligible for HRP between 1978 and 2010." Eligibility often applies to those who received Child Benefit for a child under 16.

Accounting firm Rob Laidler noted, "It is estimated tens of thousands of people are due an average of £5,000 in back payments." HMRC and DWP are conducting a broader campaign to ensure all eligible individuals are aware of this correction exercise, aiming to rectify historical errors and provide rightful compensation.
