Man jailed for infecting victim with HIV in reckless act

A man from Worcestershire has been sentenced to prison for recklessly infecting another person with HIV, following a trial at Hereford Crown Court.

A Reckless Failure to Disclose

Luke Davis, aged 31 and from Kidderminster, was convicted of inflicting grievous bodily harm on Monday, 12 January 2026. The court heard that Davis, who tested positive for HIV in August 2017 and began treatment in January 2018, knowingly put a sexual partner at risk.

Medical professionals had advised him on the critical importance of taking daily medication to suppress the virus and prevent transmission. Despite this, when he met the victim, he chose not to disclose his HIV status.

The Path to Conviction

Scientific evidence presented during the trial confirmed the victim had been infected with the same strain of HIV as Davis. The victim told the court that Davis was their only sexual partner during the period they contracted the disease.

Investigations revealed that Davis had effectively abandoned his treatment. He last attended a clinic appointment on 18 September 2018 and stopped receiving medication deliveries after September 2019. Police later found a bottle of pills from that month which remained unused. In 2021, he admitted to a social worker that he had stopped taking his medication entirely.

Giovanni D’Alessandro from the Crown Prosecution Service stated: "Davis had been on the appropriate medication and knew he had to take it every day... It was his choice to stop taking it and to stop attending clinic appointments. He further failed to inform the victim of his diagnosis and recklessly put them at risk."

A Life Sentence for the Victim

The victim, speaking of the profound impact, described living with a "life sentence" as a direct result of Davis's actions. "Luke has never had to face the consequences of his actions, nor has he ever taken responsibility for what he has done," they said.

Davis was convicted following a trial on 27 October last year and was sentenced to four years and six months in prison. Detective Superintendent Gerard Smith of West Mercia Police praised the victim's "remarkable courage" in coming forward and supporting a complex investigation.

The CPS added that they hope the sentence provides some measure of justice and acts as a deterrent against such dangerous and reckless behaviour.
