Warwick Crown Court has heard disturbing allegations that a 12-year-old girl was deliberately targeted and subjected to serious sexual offences by two men in a secluded Nuneaton cul-de-sac during a summer evening last year.
Prosecution Outlines Alleged Attack Sequence
Opening the Crown's case on Thursday, January 29, prosecutor Daniel Oscroft told jurors that both defendants allegedly targeted the vulnerable young girl in the early evening of Tuesday, July 22, 2025. The prosecution described the complainant as "very young and vulnerable" and detailed a sequence of alleged offences that began in a park area before moving to a residential location.
Specific Allegations Against Each Defendant
According to the prosecution, 24-year-old Mohammad Kabir allegedly approached the girl while she was playing in a park at approximately 6pm. Prosecutors claim he grabbed her by the neck in what they describe as an attempted strangulation, though they clarified this represents a legal definition that doesn't necessarily indicate choking occurred.
Mr Oscroft suggested to the jury that Kabir's actions could only have had sexual intent, stating: "What alternative could there have been?" Kabir faces charges of intentional strangulation, committing an offence with intent to commit a sexual offence, and attempting to take a child.
Further Allegations of Sexual Offences
The prosecution alleges that 23-year-old Ahmad Mulakhil, described as Kabir's friend, remained in the area after the initial encounter and later met the girl alone at around 8pm. According to court testimony, Mulakhil allegedly led the girl to Cheverel Place, a secluded cul-de-sac, where he is accused of raping her, sexually assaulting her, and taking indecent photographs.
Mulakhil faces multiple charges including child abduction, two counts of rape, two counts of sexual assault, and making indecent images of a child. The court heard he has already pleaded guilty to one count of oral rape of the 12-year-old.
Forensic Evidence Presented to Jury
Prosecutors presented several pieces of evidence to support their case, including forensic analysis that allegedly placed Mulakhil's DNA on both the girl's neck and the inside of her clothing. Mobile phone evidence seized after Mulakhil's arrest reportedly contained indecent images as well as photographs showing both defendants together, confirming their acquaintance.
The court heard that when confronted with CCTV footage, phone evidence, and images placing him with Mulakhil on multiple occasions including the day after the alleged offences, Kabir initially denied but ultimately accepted appearing in some footage while declining to provide explanations.
Defence Positions Outlined in Court
Both defendants, who required interpreter assistance during proceedings, have denied the majority of charges against them. Mulakhil reportedly admitted meeting the girl twice on the day in question but claimed any sexual activity was consensual. He told investigators he believed she was 19 years old based on information from his friend, despite the prosecution describing her claim of being 19 as "such an obvious lie."
Kabir provided a prepared statement denying all allegations during police interviews. The prosecution emphasised that despite language barriers mentioned by the defendants, they maintained the girl was forced to engage in sexual acts and made disclosures to adults on the same night, claiming she had also been "smacked and pulled."
Trial Continues at Warwick Crown Court
The case continues at Warwick Crown Court with both defendants maintaining their not guilty pleas to most charges. The jury of seven men and five women will continue to hear evidence in what the prosecution has characterised as a serious case of child sexual exploitation involving multiple alleged offences against a vulnerable minor.
