Dudley Nursery Worker Sentenced for Gross Negligence Manslaughter
In a distressing case that has shocked the community, nursery worker Kimberley Cookson has been jailed for three years and four months after pleading guilty to gross negligence manslaughter. The incident occurred at Fairytales Day Nursery in Dudley, where 14-month-old Noah Sibanda tragically died on December 9, 2022.
Shocking CCTV Footage Reveals Unsafe Practices
CCTV footage captured Cookson forcing Noah to sleep face down in a tepee, swaddled tightly in a sleeping bag, and covering his head with a blanket. She also restrained the toddler with her leg for seven minutes before leaving him unchecked for two hours. Noah was discovered unresponsive at 3.13 pm and pronounced dead at the hospital approximately an hour later, having silently suffocated.
Prosecutor John Elvidge told Wolverhampton Crown Court that wrapping children and covering their heads were habitual practices by all staff in the baby room. He emphasized that these dangerous sleep practices were applied to infant children regardless of age or mobility level.
Wider Consequences and Sentencing
Nursery owner Deborah Latewood received a six-month suspended sentence for failing to comply with health and safety duties. Fairytales Day Nursery Limited was fined £240,000 after admitting corporate manslaughter and ordered to pay £56,000 in costs.
Noah's mother expressed her heartbreak, accusing the nursery of playing Russian roulette with children's lives and sharing her guilt over handing her son over to those responsible for his death.
This case highlights critical issues in nursery safety and has prompted calls for stricter regulations and oversight in childcare facilities to prevent such tragedies in the future.
