The tragic event occurred on December 21, when Mr. Darke suffered a serious head injury outside the Crown Inn in Appleby Magna. He was subsequently taken to hospital, where he sadly passed away. The prosecution alleges that Gothard was responsible for the fatal assault.

During a brief ten-minute hearing presided over by Judge William Harbage KC, Gothard spoke only to confirm his identity and enter a formal plea of not guilty to the charge of murder. The defendant, who resides on Church Street in Appleby Magna, was informed that his trial has been scheduled to commence on April 27 and is expected to last for seven days.
Judge Harbage addressed Gothard directly in the courtroom, stating, "Stand up please, Nathan Gothard – you have pleaded not guilty to the charge against you. You are aware it is a very serious charge. There will be a trial, that has already been fixed for April 27. In the meantime, you will be remanded in custody."
