The conviction, which occurred at Kidderminster Magistrates' Court in February 2026, was for assault by beating. The attack took place on May 25, 2025, and the officer was fined £1,000 and ordered to pay £600 compensation. He has lodged an appeal against the conviction, scheduled for a hearing in September 2026.

Misconduct Hearing Findings

A misconduct panel determined that McTernan's actions constituted gross misconduct and breached policing standards of professional behaviour. Panel chair Debra Tedds stated: "Your conduct has brought discredit on you, West Midlands Police and the police service generally." She further emphasized that "violence against women and girls perpetrated by a police officer, whether on duty or off duty will always have a high degree of culpability." The panel noted the conduct was "deliberate, intentional, and targeted towards the victim."

Impact and Dismissal

Despite acknowledging McTernan's "long and exemplary service record" spanning two decades, the panel ruled that immediate dismissal was the "only appropriate outcome." The case highlights the force's zero-tolerance stance on domestic violence and abuse, particularly when committed by officers. West Midlands Police have stated that they are committed to upholding the highest standards of conduct and that any officer found guilty of such offences will face severe consequences.
